Legal
Terms of use
These cover using this website and what a quotation from us means. The terms of an actual build are in the contract you sign for that project — not on this page.
This page describes how we operate. It has not yet been reviewed by an advocate, and it is not legal advice. If something here matters to a decision you are making, ask us at hello@nairobuild.co.ke and we will answer it in writing.
Who these terms are with
This site is operated by NairoBuild, a contractor working in Nairobi and the surrounding counties. Using the site means accepting what is set out below. If you do not accept it, please do not use the site.
What this site is
It describes services we offer and products we supply, and it lets you send us an enquiry. That is all it does. There is no checkout and no online payment: nothing on this site is an offer capable of being accepted into a contract, and no page here creates an obligation on either of us.
Quotations
When you request a quote we reply with a written quotation for the scope as we understood it. Please read the scope before the number.
- A quotation covers the scope it states, and nothing outside that scope.
- It is valid for the period written on it. Materials pricing moves, and a quotation from six months ago is not one we can honour.
- It is prepared from the information available at the time. Site conditions that could not reasonably be known — ground conditions, access, what is found once existing work is opened up — may change the price, and we will tell you in writing before doing the work, not after.
- A quotation is not a contract. Work begins under a signed contract for the project, and where the two differ, the contract governs.
Product information in the catalogue
The catalogue is published to help you choose, and we keep it as accurate as we can. Two limits are worth stating plainly.
- Dimensions are nominal. Concrete and natural stone products carry manufacturing tolerance, and natural stone varies in colour and texture between batches. Photographs and screens shift colour. Ask for a physical sample before committing to a finish.
- Load ratings are shown only where confirmed. Where a product shows no load class, that means we have not confirmed one — not that it is suitable for any use. Do not lay an unrated product where vehicles run. Ask us and we will confirm it for the specific application.
Availability is not guaranteed by a listing. Ranges change, and a product shown here may be out of stock or discontinued when you order.
Sending us an enquiry
Please send accurate details, and do not submit other people’s personal information without their knowledge. We use what you send to answer you — the privacy notice covers what we keep, for how long, and your rights under the Kenya Data Protection Act, 2019.
Do not use the forms or our WhatsApp number to send bulk or automated messages, or to attempt to disrupt the service. We rate limit submissions and may decline enquiries.
Content on this site
The text, photographs, drawings, catalogue data and branding on this site belong to NairoBuild or to the people we licensed them from. You may read it, print it and share links to it for your own use in considering a project. Republishing it, or using it to build a competing listing, is not permitted without our written agreement.
Project photographs are published with the client’s agreement. If you believe something here is yours and should not be, write to us and we will take it down while we look into it.
What we do not promise
We aim to keep the site accurate and available, but we do not guarantee that it is free of errors or always reachable. Guidance here is general information about how we work; it is not a design, an engineering opinion or a specification for your site. Do not treat an article or a product page as a substitute for a quotation and a site visit.
Where the site links to other organisations, we are not responsible for their content.
Nothing in these terms limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, or for fraud. Our responsibility for the work itself is set by the contract for that project and by Kenyan law.
Changes
We may update this page as the business changes. The version published here is the one that applies from the day it appears, and it does not change a quotation you have already accepted or a contract already signed.
Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction. If part of this page turns out to be unenforceable, the rest of it still stands.
